STEP ONE: HOW IS MEDICAL MALPRACTICE PROVEN IN MARYLAND?
Maryland law requires certain elements to be proven in a medical malpractice claim. Essentially you need medical experts testify as to the standard of care owed to you at the time and whether your treating doctors departed from the standard of care, causing your injury.
Your medical experts will come to this conclusion by reviewing your medical records and other pertinent information available. Once this analysis is complete you should have a good idea as to the strength and weaknesses of the case.
WHAT CAN BE DONE IF FIRST LAWYER SAYS YOU DO NOT HAVE A MEDICAL MALPRACTICE CASE?
If your lawyer does an investigation into your situation and comes to the conclusion that you do not have a good claim, you can move on to another lawyer for a second legal opinion. Remember, when a lawyer gives you their thoughts on your case that is that lawyer’s opinion. Another lawyer may or may not agree with that assessment.
If you step back and assess the situation, this same thing happens in the medical arena. When a patient feels the need to get a second opinion from another doctor, they make it happen. Getting a second legal opinion can work the same way.
