Many people do not understand that in order to bring a case in the circuit court in Maryland, each case must have a medical expert go on records stating how the treating doctor/hospital fell below the standard of care. Standard of care generally means, what a reasonable and prudent medical professional do under the same circumstances.

When investigating, and preparing these cases, attorneys must have a medical expert go on record. In order for the medical expert to go “on record,” he or she must have an opportunity to review the medical records in order to form a professional opinion about whether your treating doctor fell below the standard of care.

 

If you do not already have your medical records, the attorney must request and retrieve the full and complete medical record. This takes time and it also costs the attorney to get the records. Additionally, the expert doctor routinely charges the attorney to review the records. Depending on the complexity of the case, often more than one expert may be needed. Each expert must review the relevant records.

 

If your injuries are on the lower end financially, then a lawyer may tell you that your case is not worth enough. By lower end, we mean cases that do not have much for past and future medical care. After paying for medical records, and paying experts and repaying your insurance company and legal fees, there’s not much left for the client.

 

HOW DO YOU KNOW THE VALUE WITHOUT TAKING MY CASE

 

The exact value of the case isn’t determined until the case reaches verdict or settlement. However, an attorney can give an estimated case value based on the nature of the injury, whether the injury has left a permanent effect, whether the person will need any future medical care, the extent of the present medical care, any loss of wages, etc.
