I almost died during surgery now I’m ready to sue! I mean I could have died because of what those doctors did to me. Luckily, everything worked out for me and now I can move on. But with that said, I want to sue those doctors and the hospital.
Because of the serious nature of surgery, it can be understandable that an individual would want to hold those responsible for causing, what they deem, an injury based on the fact that they almost died. But will this alone be grounds for a medical malpractice in Maryland when you “almost die?”
HOW TO PROVE A MARYLAND MEDICAL MALPRACTICE CLAIM…
Maryland law requires that to be successful in these types of cases you have to meet these four elements:
- DUTY
- BREACH OF DUTY
- CAUSATION
- DAMAGES
For this educational article, I am going to focus on the fourth element, damages. For the purposes of this article the best way to think about damages is the harm done to you. If you have no harm, or damages then you will have a hard time prevailing in a Maryland medical malpractice claim.

Once we step back and take the emotion out of the equation, the answer to the question above in these set of facts should be clear. The short of it is that almost dying with no other complications will not rise to Maryland medical malpractice in general because there are no damages.
As serious as almost dying is, you did not die (thankfully so!). Under the set of facts above, the doctors were able to make repairs to the issues which occurred during surgery and the patient did not suffer any long term or permanent damages/injuries.
