This question was asked to me by a person who contacted my office. Because the person had already spoken to another lawyer about things and decided to go in another direction, they had questions for me about who pays for the costs of bringing a medical malpractice case.

 

WARNING…THIS IS GENERAL INFORMATION!

 

Before I get too deep into this discussion I want to remind you that I am giving you basic and general information regarding this issue surrounding costs. You have to make sure that you speak to the attorney you are thinking about hiring before signing your name to a fee agreement. This is because every law firm might handle this issue differently and you want to make sure that you understand how the firm you hire deals with things.

 

ARE YOU STUCK HOLDING THE BAG FOR COSTS

 

Costs in a Maryland medical malpractice case would be things like the costs to hire medical experts, or the costs associated with taking a deposition, or the costs associated with filing the case, or the costs associated with retrieving the medical records, etc… These are just some of the examples of costs in cases like these.

 

As I mentioned above, different law firms might deal with costs in a different way. For example, one firm might say that you only have to repay costs if we win. Another firm may say that you pay for costs regardless of whether we win or lose the case and that the costs are your responsibility.

 

WHY IS IT IMPORTANT TO UNDERSTAND COSTS?

 

One reason why you want to understand costs is because you want to know your responsibilities when you hire a law firm. Remember, when you enter into a contract with a law firm there are two parties to the agreement. You and the firm. Add to this, when money is involved you want to always make sure that you have a clear understanding regarding your correct share.
