Can I sue in Maryland for baby brain injury at birth?
This is a question that crosses the minds of many parents when their child has suffered a brain injury after a vaginal delivery.
Any type of brain injury to a child can be devastating with cerebral palsy being one of the leading causes of mobility inflictions.
The question on the minds of many parents is how a brain injury can happen and when it does it can lead to the ultimate question of can I sue in Maryland if baby has a brain injury?
WAS THE BABY IN FETAL DISTRESS?
When a mother heads into the delivery room to have her baby doctors have to make sure that they are paying close attention to how the baby is dealing with the delivery.
Not only are the doctors and nurses paying attention to the baby, but they are also paying attention to mom.
To monitor the baby the doctors use a device called the fetal heart monitor.
The fetal heart monitor tells the doctors essentially how the baby’s heart is holding up to the delivery.
HOW WILL DOCTORS KNOW IF BABY IS IN TROUBLE?
One quick sign which will tell doctors how the baby is doing is whether there is the presence of meconium when the water breaks.
Meconium is stool and it should alert doctors that the baby has to be watched closely.
The second way doctors can know that the baby may be in trouble is if the baby’s heart rate is too high for a considerable amount of time or is too low, for a considerable time.
In general the baby will have a heart rate of around 110bpm-160bpm.
If the baby’s baseline heart rate is not in the acceptable ranges than hypoxia may be present.
Hypoxia in simple terms deals with a lack of oxygen.
A lack of oxygen can lead to a number of issues, including a cerebral palsy diagnosis.
