Can I get a second opinion if my child was injured during birth?
This is a question that many parents have when they are informed not only that their child has suffered an injury at birth, but this question can surface regarding the cause of the injury.
If you too have this question then hopefully this educational article and supporting video will give you a better understanding as to this issue.
“WHEN DOES THIS QUESTION USUALLY ARISE?”
Parents who are told that their child was injured during birth, and that it was due to genetics can sometimes wonder if a second opinion is needed.
Especially when the child has a medical condition that neither parent has seen manifested in their families.
In cases like this, some parents begin to wonder would a second opinion help clear up some of their questions.
“BUT WILL MY DOCTOR BE MAD AT ME?”
Parents can sometimes worry that if they get a second opinion their doctor is in some way going to be “mad at them” for getting a second look at things.
One thing that parents have to remember is that they have to look out for the best interests of their child.
If the parents think that a second opinion would help the child, or give insight into treatment opinions, etc…then the parents may really need to push for that second opinion.
ONE MORE THING ABOUT THE DOCTOR “BEING MAD.”
In this area of the law we have to from time to time tell clients that in our legal opinions we do not think that they will be successful with their claim.
When we inform the client of this, we are sure to advise them to have another attorney look at the case for them.
One of the reasons being is that another attorney may have a different theory of the case or get a different take on the case from their expert.
This is fine because of us we always want what is best for the client.
Think about it this way, shouldn’t your doctor want what is best for his or her patient too?
WHERE CAN I GET HELP WITH A SECOND OPINION?
If you decide to contact a Maryland childbirth attorney regarding your child’s injury that attorney is going to have to have a medical expert review your child’s case.
This means that the attorney will have a medical expert look at your child’s medical records and give an opinion as to whether the treating doctor or hospital was really the cause of your child’s injury and not genetics or something the mom did.
If the attorney’s medical expert agrees with what your doctors are telling you then the attorney will inform you of this.
On the other hand, if the medical expert disagrees then the attorney can go more into depth with you about the possible options, if you choose to go further.
