Experts on standard of care and causation are really important in a Maryland medical malpractice case.
Individuals who are trying to represent themselves in a Maryland medical malpractice case often have questions about the use of medical experts.
If you are reading this educational article or watching the corresponding video, you too may have the same questions.
Hopefully by the time you are finished reading you have a better understanding of things.
MARYLAND LAW IS THE CULPRIT…
For those who have followed our educational videos you know that we talk a lot on the use of medical experts in these cases.
The reason this is the case is because Maryland law requires that a qualified medical expert give an opinion as to the standard of care, and how the deviation of the standard caused your injury.
Plaintiffs who do not have this requirement will not be successful in their case.
WHAT DO YOU MEAN STANDARD OF CARE?
One of the easiest ways to remember what the standard of care deals with is like this…what would a reasonable and prudent doctor do in the same situation as your doctor?
For example, would a reasonable and prudent doctor cut somewhere on the body without identifying what they are cutting first?
Is this what a reasonable doctor would do?
To be successful in your case your medical expert is going to have to outline what was the standard of care for your case.
SO HOW DOES CAUSATION PLAY INTO THIS?
Causation is the other piece of the puzzle in that an expert has to be able to tie everything up.
In other words, your injury has to be the result of the action, or inaction of the doctor or hospital.
If you cannot show that your injury was caused by the treating doctor then more than likely you will not be successful with your case.
