As the title of this post suggests, it deals with a mother’s reflection on the impact on her baby’s HIE brain injury. With that said, there is another layer to this post that deals with her views surrounding, in her words, the medical malpractice, which caused her baby’s brain injury. The main point of this educational video is to share this story so that others in this situation can make sure that they are looking at these issues from all perspectives.
At the end of the day, we are essentially discussing the statute of limitations and their impact in the lives of injured people. I am not aware of any state which has an “unlimited” amount of time to bring a claim for injured people.
A Mother’s Reflection On The Lifelong Impact On Her Baby’s HIE Brain Injury
The story that I am sharing deals with a parent who felt that her baby suffered an HIE brain injury because of negligence at the hospital. Although the family felt this way, because, as was reported to me, they were not “sue” people, a decision was made not to even consult with a birth injury lawyer because, again, this was not a “sue” family. To them they felt that God would take care of things.
Because this baby has a moderate to severe HIE injury, a considerable number of resources are needed. During my talk I was able to see that much of the reasoning surrounding the then baby’s condition was focused on just that, the baby being a baby. Here is the thing, the baby will not be a baby forever.
When the family spoke to me that “baby” was now over 25 years old and the family did not have the same views regarding looking down on those who sued to hold those responsible for injuring others. The parents are now closing in on 60 years old and can no longer do the things they could do when younger regarding their injured adult child. Moving and turning an adult for care is not the same as moving and turning a baby.
Time Will Eventually Run Out…
By the time this family reached out for help, the statute of limitations had run out for not only any claims that they may have had, but also for their adult child according to their research. As I mentioned above, the law places time frames on these types of things.
You do not get forever to bring these types of claims. For this family, their initial views about the legal system and suing those responsible for injuring others did not stand the test of time. As one person who is religious told me in the past, God will put people in our lives who can help us, we just have to see them and ask for help.
