The entire process can take several months up to several years to complete. Rarely does a medical malpractice incident/case get resolved in a matter of a few months. The process can take a while. Once a case begins, the attorney must be certain that the necessary paperwork is filed in the appropriate location and the other party must be served. Once the case is filed and answered in the appropriate court, the court will issue a scheduling order detailing the deadlines for steps of the case. The scheduling order could depend on the assigned track, the assigned judge, the jurisdiction and the court the matter is filed in among other aspects.
