How long will it take? To put the question another way, will you be able to get through a Maryland medical malpractice case in a couple of months? The inspiration for this educational article came from a conversation I recently had with an individual.

 

He called me because of an issue he had following a surgery. After he briefly described what was going on, a common theme developed in his questions. “Mr. Boston, how long will it take?”

 

HOW TO PROVE MEDICAL MALPRACTICE IN MARYLAND. . .

 

To understand the answer to the question of how long will it take to get through a Maryland medical case, one must understand the process. The law in Maryland requires that you prove that your treating doctor departed from the standard of care owed for you, causing your injury.

 

The above is proven through the use of medical experts. These experts will review all relevant information in the case and give certain opinions. Medical experts will generate reports based on their opinions.

 

When each side in the case determines the experts that they will be using, the adverse side will get notice of the potential experts to be used at trial. Once the adverse side has been put on notice of the experts, that side will have an opportunity to depose these experts.

 

A deposition is a question and answer session. Since depositions take place in this setting once the case is filed in the appropriate court, each side is able to make any objections that they feel they need to make to protect their interests.

 

HOW LONG WILL IT TAKE?

 

Based on what is explained in the paragraph above, you should be able to see that the Maryland medical malpractice track is a lengthy process. I only highlighted a small part of the process.

 

Working to completion in a Maryland medical malpractice case can take years. Therefore, I stress to people who contact my office that they MUST have patience. You must be in it for the long haul. There is a lot that has to happen along the way and at a certain point, there is not much that you can do to make things go any faster.

 

For me, if I feel that a potential client will not be patient enough to go through the process, I will generally decline the case. This is because a strain on the attorney-client relationship will usually ensue.
