One of reason we are told by parents as the cause of their child’s brain injury at birth is that the injury is genetic.
In other words, there was nothing that caused the child’s injury other than the genetics of the parents.

A couple of days ago, as of the writing of this educational article, I was contacted by a mother who had a child who was suffering from a brain injury.
Genetics, as the cause of the injury had been mentioned to her and the child’s father.
With that said, the parents were doing their homework to make sure that they were covering all of their bases as to not only the cause of their child’s injury, but for potential treatment options as well.
Mom was sure to explain to me that there had been “no problems” noted during her pregnancy.
During my conversation with them I stressed to them the importance of getting the medical records from the birth.
Not only did I explain to them the need to request the mother’s records, I also explained the importance of requesting the baby’s records too.
The Duel Role Of The Medical Records…
As I spoke with mom, I explained to her that the child’s medical records would be important because if they were looking to get a second opinion as to their child’s condition, the records would help the second opinion doctor get a good understanding of what happened.
Sometimes a second opinion doctor will have not only a different opinion as to the cause of a medical condition or injury, but this doctor may also have a different suggestion as to possible treatments.
All of this information is very important to parents in cases like these as this information may open up a different set of options not originally considered.
The Second Role Of The Medical Records…
If parents are eventually looking to take legal action because they understand that their child’s brain injury during birth was due to the carelessness of a doctor or hospital, they will need the medical records.
The reason this is the case is because Maryland law requires that another medical expert must give an opinion as to the case.
This medical expert will testify as to whether the treating doctor gave good and acceptable medical care to the patient and whether the medical care given was the cause of the patient’s injury.
In cases like this, an attorney will review mom and baby’s records with their medical expert and come to a conclusion as to whether the case may have merit legally.

After speaking with mom by the end of the conversation it was clear that she and the family were going to request the medical records from the birth, regardless of the cost.
For them it was a matter of making sure that they had researched all of their options, especially when the doctors said her child’s birth brain injury was genetic.
